The data we collect
Depending on what you do, we may collect:
- Identification and contact details: surname, first name, email, telephone.
- Your property project: municipality, type of property, budget, your situation (buying, selling, valuation) and the content of your messages.
- Your member account (Le Cercle YOUHOME): your login credentials and your search criteria.
- In the course of a transaction: the data required by our legal obligations, in particular a copy of your identity document (anti-money laundering).
- Audience measurement: fully anonymous visitor statistics, with no tracking cookie (see our cookie policy).
Why we process it, and on what basis
Each processing operation rests on a specific legal basis under the GDPR:
- Responding to your request (contact, valuation, viewing, access to Le Cercle): submitting a form constitutes a request on your part. We process your data on the basis of pre-contractual measures taken at your request and of our legitimate interest in responding to it.
- Carrying out our work as an estate agent (agency agreement, marketing of the property, support): the performance of the contract between us.
- Analysing your property project (your search criteria, your valuation request): the performance of the service you request by creating your member account. No information about your property or your project is published without your consent.
- Complying with our legal obligations: anti-money laundering (identification of the parties), IPI professional ethics, accounting and VAT.
- Sending you our communications (properties matching your search, news): only with your explicit consent, given through a dedicated sign-up box and withdrawable at any time.
- Measuring website traffic: our legitimate interest in knowing how often our pages are visited, using an anonymous, cookie-free solution.
- Protecting our forms: our legitimate interest in preventing automated submissions and abuse.
Who has access to your data
Your data is intended for YOUHOME and its technical processors, which act on instructions and under data processing agreements that comply with the GDPR. It may be passed on to third parties where the law or the transaction requires it (notary, authorities). We never sell your data.
- Cloudflare, Inc. (United States): hosting of the website, the database and files, and delivery of emails.
- Meta Platforms, Inc. (United States): Facebook and Instagram advertising campaigns and lead forms.
- Google LLC (United States): sign-in to the member area and synchronisation of appointments.
- GatewayAPI (Denmark): sending service text messages, such as appointment reminders and confirmations.
- Plaud: transcription of the meetings and calls our agents record, to produce the summary that feeds into your file.
Some of these providers are based in the United States. Transfers of data outside the European Union are governed by the EU-US Data Privacy Framework (adequacy decision of the European Commission) where the provider is certified under it, and, additionally or failing that, by standard contractual clauses.
Our videos and YouTube
The videos of our properties are hosted on the YOUHOME YouTube channel. Our internal management tool uses the YouTube API Services to publish our videos there, change their title, description and visibility, track their upload and delete them. This tool is reserved for the YOUHOME team: it only accesses our own channel, and never a visitor's YouTube account.
The only data we keep from YouTube is the identifier of each published video and its status (uploading, private, unlisted or public). It is erased when the video is removed from the channel or from our tool, and at the latest thirty days after our access is revoked. YOUHOME may revoke this access at any time from the permissions page of its Google account.
When you watch one of our videos, on our website or on YouTube, you are using YouTube's services: the YouTube Terms of Service and the Google Privacy Policy apply.
How long we keep it
We keep your data only for as long as necessary for the purposes for which it was collected: no data is kept indefinitely. The period depends on the category of data, and the criterion that determines each period is set out below:
- Prospects (you contacted us without creating an account): 3 years from your last contact.
- Clients (after a service relationship): 3 years from the end of the relationship.
- Transaction files (agency agreement, sales agreement (compromis), deed and related correspondence): 10 years from the completion of the sale, to cover the ten-year statutory limitation period.
- Invoices and fees: 10 years from 1 January of the year following their issue, under the statutory VAT record-keeping obligation.
- Identity documents collected for anti-money laundering purposes: 10 years from the end of the business relationship, under the statutory anti-money laundering obligation.
- Proof of your marketing consent: 3 years after you unsubscribe, so that this consent can be demonstrated.
- Le Cercle YOUHOME member account: kept for as long as your account remains active, then deleted after 3 years of inactivity.
Documents subject to a statutory retention obligation (invoices, identity documents) follow their own period, even after your account is closed or your other data is deleted.
Your rights
Under the GDPR, you have the following rights:
- Access: obtain a copy of the data we hold about you.
- Rectification: have inaccurate data corrected.
- Erasure: request the deletion of your data.
- Restriction: temporarily restrict the use of your data.
- Objection: object to processing based on our legitimate interest and, at any time and without giving a reason, to direct marketing.
- Portability: receive your data in a structured, readable format.
- Withdrawal of consent: withdraw any consent given at any time (for example via the unsubscribe link in our emails), without affecting processing already carried out.
