# Selling again within five years: will the capital gain be taxed?
No, not automatically. A quick resale can result in taxation, but an exemption exists, notably for your own home, subject to conditions. Before setting your sale timetable, ask your notary or tax adviser to check the use of the house, the dates and the calculation. The difference between purchase and resale prices is not enough to establish your tax liability.
## Why check the deeds before deciding?
For a building in Belgium acquired for consideration, FPS Finance describes a specific regime when disposal takes place within five years of acquisition. Fednot explains that the relevant dates are those of the notarial deeds. A property received as a gift, or a house built on land acquired earlier, requires a different timeline: do not count only from when you moved in. [Sources: FPS Finance, section XV, heading B, 7, pages 16 and 17](https://fin.belgium.be/sites/default/files/media/documents/explications-partie-2-2026.pdf) and [Fednot, taxes on property capital gains](https://www.notaris.be/node/224).
For a house with a large garden, also have the property actually being sold classified for tax purposes. Land follows separate rules; the presence of a garden alone does not determine the tax regime.
## Is your own home exempt?
The FPS Finance brochure provides an exemption for a dwelling that was your own home (habitation propre) for an uninterrupted period of at least 12 months immediately preceding the month of disposal. A period of vacancy of no more than 6 months may fall between that period and the month of disposal. Previous registration as your home does not therefore secure an exemption without examining actual occupation and the timeline. If you have moved out, let the house or used part of it for professional purposes, have your situation examined before committing to a date. To budget for this check, ask your adviser for the cost of the assessment and a documented calculation of any tax, rather than applying a rate to the entire price increase.
## Is the price increase the same as the taxable capital gain?
No. The official calculation distinguishes, among other things, the basis used on sale, disposal costs, the acquisition basis, acquisition costs, certain increases and work supplied and invoiced to the owner. Keep the supporting documents: not all work you carry out yourself becomes an allowable expense for tax purposes. [Source: FPS Finance, section XV, heading B, 7, pages 17 to 19](https://fin.belgium.be/sites/default/files/media/documents/explications-partie-2-2026.pdf).
Your available budget is a separate matter again. For your next purchase, compare the intended selling price with the outstanding mortgage, selling costs and any verified tax liability. A market valuation does not replace this completion statement.
## Which documents should you prepare with your adviser?
- The acquisition deed and any gift deeds or inheritance documents.
- The dates of occupation, departure and letting, with the use of each part.
- Supporting documents for costs and invoices for work; for a new build, the construction dates and date of first occupation.
- A current valuation and the mortgage redemption statement, to distinguish tax from available budget.
In the Province of Liège, we advise comparing the tax timetable with your housing needs and the costs you will bear while waiting. Postponing a sale without costing these factors does not tell you whether waiting is worthwhile.
## Which answers matter before reselling?
### Is all taxation ruled out after five years?
No. Fednot distinguishes quick resale from speculation. A professional activity requires a different assessment again. Time alone therefore does not establish that every capital gain is exempt. [Source: Fednot, section on speculation](https://www.notaris.be/node/224).
### Does a second home automatically qualify for the exemption?
No. The exemption described for your own home does not automatically apply to a second home. Have its use and the conditions of the applicable regime checked.
### Does my house valuation show my net profit?
No. It establishes a market value. The financial completion statement and tax assessment then help establish what will remain for your project.

Selling again within five years: will the capital gain be taxed?
Reselling within five years does not automatically mean paying tax. The use of your house, deed dates and tax calculation: the checks that matter.
