An offer without a mortgage condition is not proof of funds. Before accepting it, check how the price will be paid, what the timetable depends on and what the offer provides if a difficulty arises. The absence of the clause may inform your decision, but it guarantees neither payment nor a quicker deed of sale.
For your house in Liège or elsewhere in Wallonia, relate these checks to your next purchase, your move and the property being vacated. A higher price does not automatically compensate for an uncertain timetable.
## What does an offer without a mortgage condition mean?
A suspensive mortgage condition protects the buyer if financing is not obtained, according to the agreed wording. The amount sought, the deadline, the steps to be taken and notification of a refusal must be considered together. [Notaire.be explains the precautions to take at the offer stage](https://www.notaire.be/actualites/faire-une-offre-sur-un-bien-immobilier-precautions-et-conseils-juridiques).
Without this condition, the prospective buyer may still be relying on a loan. They simply do not have the contractual protection that this clause would have provided. No clause and no borrowing are therefore two different things. Have the rules applicable to your transaction checked before deciding, particularly for a public sale or an off-plan purchase.
## How can you check the proposed financing?
Ask the prospective buyer to clarify the intended resources and what remains to be obtained:
- their own funds that are already available;
- borrowing that still requires a bank decision;
- the expected proceeds from selling another property.
A loan simulation describes a scenario. An agreement in principle may contain reservations. A statement must be read with its date, purpose and conditions in mind: its title does not guarantee payment. Agree with the agency and notary which supporting documents are useful, without collecting the buyer's entire banking file. Missing information needs clarification, not assumptions.
## What does the payment timetable depend on?
Funds described as available cannot necessarily be used on the intended day. Have the remaining stages clarified: the lending decision, the sale of a home, the signing of a deed and the actual availability of the money.
An illustrative example: one buyer already has their own funds; another is waiting for their sale proceeds. Both proposals may be serious. The second requires an additional check on the progress of that sale and the availability of the price. This difference alone does not justify automatically preferring one buyer over another.
Have the feasibility of the timetable assessed before relying on it for your next purchase. If your plans remain flexible, a documented dependency may carry different weight than if you must pay for your new home on a fixed date.
## What should be reviewed before you accept?
A complete offer accepted in accordance with its terms may already bind the parties before the sales agreement (compromis). The contract is formed when acceptance reaches the person making the offer, under the applicable rules. A change to an essential or substantial element is not an unqualified acceptance: [Civil Code, articles 5.18 to 5.21](https://www.ejustice.just.fgov.be/eli/loi/2022/04/28/2022A32058/justel).
Have the price, the offer's validity, deadlines, occupation, other conditions and deposit arrangements checked. 'Without a mortgage condition' does not mean 'without any conditions'. A reservation relating to a prior sale may change how the timetable should be understood.
For the deposit, clarify the amount, the deadline and the receiving account. Notaire.be recommends the notary's protected client account. This money is neither the full purchase price nor compensation to which the seller is automatically entitled.
If a mortgage is refused, the absence of the clause does not, by itself, provide a contractual exit. Nor does it trigger automatic compensation. Have the commitments and remedies examined before claiming a sum or putting the house back on the market. Do not assume that a condition can be added unilaterally to the sales agreement (compromis) after acceptance.
## What are the answers to frequently asked questions?
### Does no mortgage condition mean no borrowing?
No. Ask how the purchase will be financed and what remains to be obtained. The wording alone does not prove that funds are available.
### Is a bank's agreement in principle enough?
Not on its own. Have its scope, reservations and date examined, then compare it with the proposed financing and timetable.
### Can you wait until the sales agreement (compromis) to review the offer?
No. Have it reviewed before acceptance: a binding commitment may already arise at that stage. The sales agreement (compromis) does not provide an automatic cooling-off period.
